Abstract

Legal Challenges and Solution Approaches for Open Data in Clinical Psychological Research Abstract: Open science practices are becoming increasingly important in clinical psychology research, but they pose particular legal and ethical challenges for researchers. This article provides an overview of the key legal frameworks in the German-speaking countries, focusing on data protection, copyright, and other relevant research rights, highlighting their importance for open data, open materials, and open access. It provides practical recommendations for consent processes, data preparation, and legally compliant publication channels. Additionally, it discusses special considerations for vulnerable groups, such as minors, individuals with neuropsychological disorders, and individuals unable to give consent. It presents requirements in the context of multicenter studies or clinical institutions. The article offers concrete solutions for anonymization, selecting suitable repositories, implementing tiered access controls, and coordinating with data-protection officers and ethics committees. The aim is to provide researchers with sound guidance on implementing open science in clinical psychology research in a responsible, legally compliant, and ethically reflective manner.
