Abstract

Drawing from the Pinheiro Case, the article investigates the accountability measures available in the Brazilian legal system for situations of serious human rights violations caused by large corporations, describing their application to the specific case. By concluding that legal practice does not fulfill the desire for justice in cases of major disasters, especially from the point of view of the victims, the norms of international human rights law and the necessary protection of relevant legal assets, the political-criminal reasons for a more comprehensive adoption of the criminal liability of legal persons in the Brazilian legal system are established.
